Measures of Chongqing Liangjiang New Area for Charging Shanghe Price Dispute Mediation Center (for Trial Implementation)

Article 1 These Measures are formulated in accordance with the Mediation Rules of Shanghe Price Dispute Mediation Center in Liangjiang New Area of Chongqing for the purpose of regulating the fees charged by Shanghe Price Dispute Mediation Center in Chongqing.

Article 2 These Measures shall apply to mediation cases of Shanghe Price Dispute Mediation Center (hereinafter referred to as "Mediation Center") in Chongqing Liangjiang New Area.

Article 3 Case registration fee

If a party submits an application for mediation to the mediation center, it shall pay the case registration fee. If the respondent agrees to submit the dispute to the mediation center for handling, the mediation center will make the Acceptance Decision and serve it on all parties. The respondent shall pay the case registration fee within 5 working days after receiving the Acceptance Decision or the notice from the mediation center. The case registration fee shall be charged by each party in RMB and 300 yuan, and shall be borne by each party. If the parties have otherwise agreed on the expenses, they shall pay according to their agreement. If the party concerned withdraws the mediation application after paying the case registration fee, the case registration fee will not be returned.

Article 4 Case mediation fee

If the case is successfully mediated, the mediation center will charge the parties a mediation fee.

There are two ways to charge the mediation fee: the parties can pay the mediation fee according to a certain proportion of the target amount, or they can choose to pay the mediation fee according to the hourly rate.

The mediation fee is calculated and paid in RMB. The parties may pay foreign currency with the consent of the mediation center. After the settlement of fees, the mediation center will issue a formal invoice to the parties.

Article 5 If the parties choose to pay the mediation fee in proportion to the amount of the subject matter of the case dispute, the mediation center shall collect the mediation fee in stages according to the following standards:

(a) no more than 100 thousand yuan, each pay 1500 yuan;

(two) 100 thousand yuan to 200 thousand yuan (including 200 thousand yuan), according to 1% to pay;

(three) 200 thousand yuan to 500 thousand yuan (including 500 thousand yuan), according to 0.75% to pay;

(four) 500 thousand yuan to 1 million yuan (including 1 million yuan), according to 0.5% to pay;

(five) 1 million yuan to 2 million yuan (including 2 million yuan), according to pay 0.45%;

(six) 2 million yuan to 5 million yuan (including 5 million yuan), according to pay 0.4%;

(seven) 5 million yuan to 10 million yuan (including 10 million yuan), according to 0.35% to pay;

(eight) 10 million yuan to 20 million yuan (including 20 million yuan), according to 0.3% to pay;

(nine) more than 20 million yuan, according to 0.25% to pay.

The amount of the subject matter is subject to the total amount of the subject matter involved in the dispute. If the disputed subject matter is difficult to calculate, the on-time charging standard shall apply.

Article 6 If the parties choose to pay the mediation fee at the hourly rate, and the subject matter of the dispute does not involve property or the amount of the subject matter of the dispute is difficult to calculate, the mediation center shall collect the mediation fee according to the following standards:

(a) no more than 500 thousand yuan, according to the 1000 yuan/hour billing;

(two) 500 thousand yuan to 1 million yuan (including 1 million yuan), according to 2000 yuan/hour billing;

(three) more than 1 million yuan, according to 3000 yuan/hour billing;

(4) If there is no disputed amount or it is difficult to calculate the disputed amount, it will be charged at 2000 yuan/hour.

Only the effective time for the mediation center to carry out the case mediation work is recorded in the on-time billing, including: the mediator's reading papers, online or offline mediation meetings, and the field visit time needed for mediation.

Article 7 Other expenses

If the mediator thinks it is really necessary and the parties agree to visit and investigate in other places, the actual expenses such as accommodation and transportation expenses of the mediator shall be borne by the parties through consultation according to the standards agreed by the parties and confirmed by the mediation center.

The expenses incurred by employing relevant third parties (such as experts, witnesses, translators, appraisers, etc.) to participate in the mediation work shall be borne by the parties through consultation.

The above other expenses shall be borne by the proposing party if the parties fail to negotiate.

Article 8 The charging methods and standards for accepting commercial dispute cases appointed or entrusted by the people's court by the mediation center shall be charged according to one-half of the Measures for Payment of Litigation Fees; The mediation center accepts the charging methods and standards of commercial dispute cases appointed or entrusted by the arbitration commission or other dispute settlement institutions. If there are special provisions, such provisions shall prevail.

The mediation center can reach an agreement with the commercial subject on providing mediation services for specific types and group cases according to the actual situation, and collect mediation fees according to the agreement.

These Measures shall be adopted and interpreted by the Council of the Mediation Center, and shall be implemented as of the date of promulgation.
